Notes

1 Website operators should notify their users when they intend to materially change how they use users' personal information and obtain the users' affirmative agreement (opt-in) to the change. This notice typically is provided via (i) email, (ii) a notice posted on the website requesting click-through consent, and (iii) often both of the foregoing. It should be noted that users not responding to an email explaining the changes to the privacy policy are not deemed to have given their consent and a site operator should then treat their information according to the privacy policy in effect at the time their information was collected. This means that information collected under different privacy policies may need to be maintained separately. Website operators should therefore adapt this section to reflect exactly how the site operator notifies users of policy changes.
